Aktuelle Einreiserestriktionen in die USA und die rechtliche Möglichkeit der NIE 

Seit Beginn der Pandemie im März 2020 haben die USA als erstes Land insbesondere die Einreisen vor allem aus dem Schengen-Raum, England und Irland fast vollständig untersagt. Diese vorübergehenden Einreisebeschränkungen hat die Administration unter Donald J. Trump ab dem 26. Januar 2020 beabsichtigt aufzuheben. Der neu gewählte Präsident Biden hat dies jedoch umgehend dementiert und die Aufhebung der Einreise u.a. aus vorbenannten Regionen rückgängig gemacht und bis auf Weiteres ausgesetzt.

Demnach dürfen nach wie vor nur US-Staatsbürger (amerikanischer Pass) oder Greencard-Inhaber in und aus den USA reisen. Eine sehr enge Ausnahme gibt es für diejenigen Personen, die eine sogenannte National Interest Exception (kurz NIE) erfolgreich erhalten, d.h. eine Sondereinreisegenehmigung, die im nationalen US-Interesse liegt. Dies kann jeweils in den wochenaktuellen Presidential Proclamations PPs der US-Regierung unter 9993 und 9996 öffentlich erfahren werden.

Um diese Voraussetzungen zu erfüllen, müssen wie bereits zu erwarten ist, ganz konkrete und dringende fortgesetzte Interessen mit den USA bestehen. Dies können und sind vor allem wirtschaftliche, berufliche und finanzielle Kriterien. 

Demnach können insbesondere Geschäftsführer, Firmeninhaber und Unternehmer mit engen Beziehungen zu den USA einreisen, wenn der Grund und Anlass nachgewiesen werden können. Private Reisen sind bereits von vornherein ausgeschlossen, ebenso touristische Zwecke und Urlaubsreisen. Auch die Immobilie in den USA z.B. als Feriendomizil oder vermietetes Eigentum stellen keinen Grund dar, um in die USA einzureisen. 

Wir haben jedoch bereits in Ausnahmen hierzu für Personen des Öffentlichen Lebens, insbesondere Leistungssportler und Musiker (von übernationalem Interesse) aus Deutschland und Europa erfolgreich eine NIE beantragt, insbesondere wenn die enge Verknüpfung zu den USA nachgewiesen und dokumentiert werden kann sowie der aktuelle dringende Anlass, in die USA zu reisen. Das zuständige Department of State fordert hier im Einzelfall unter anderem qualifizierte Reisende, die entweder aus humanitären, beruflich medizinischen oder sicherheitspolitischen Gründen (national security) einreisen und/oder die Einreise im nationalen US-Interesse liegt.

Wichtig ist vorab zu wissen, dass die NIE nur in Zusammenhang mit einem gültigen Non-Immigrant-Visum oder einem gültigen EStA-Non-Immigrant Visum beantragt werden kann und sodann bei positiver Bescheidung die einmalige Einreise innerhalb von 30 Tagen erfolgen muss. Bei einer Rückreise und beabsichtigter nochmaliger Einreise muss je gesondert eine neue NIE beantragt werden. Dies gilt für alle Antragsteller.

Daher sollte bei der Beantragung bestmöglich von Beginn an Ihre Anwältin eingeschaltet werden, um eine Ablehnung zu verhindern. Denn eine solche ist sodann im System auch der Homeland Security hinterlegt, was eine erneute Beantragung folglich erschwert bis unmöglich machen könnte.

Current entry restrictions to the United States and the legal possibility of NIE 

Since the beginning of the pandemic in March 2020 the United States have been the first country to almost completely ban entry, especially from the Schengen area, United Kingdom and Ireland. The administration under Donald J. Trump intended to lift these temporary entry restrictions on January 26th 2020. However, the newly elected President Biden immediately denied this and reversed the suspension of entry from the aforementioned areas and suspended it until further notice. 

Accordingly, only US citizens (US-American passport) or green card holders are still allowed to travel to and out of the US. There is a very narrow exception for those people who successfully receive a so-called National Interest Exception (NIE), i.e. a special permit that the entry is in the national US interest. This can be found in the weekly Presidential Proclamations PPs under 9993 and 9996. 

In order to meet these requirements, as is to be expected, there must be very specific and urgent continued interests of the US. Above all these can be especially economic, professional and financial criteria. 

Accordingly, managing directors, company owners and entrepreneurs with close ties to the US in particular can enter the United States if the purpose and content can be proven. Private trips are excluded from the outset, as are only tourist purposes and vacation trips. Even real estate property in the US, e.g. as a vacation home or rented home owner property, e.g. is no reason to enter the US under the travel ban. 

However, we have already successfully applied for an NIE for people of public life, in particular popular competitive athletes and musicians from Germany and Europe (of supranational interest), especially if the close connection to the US can be proven and documented as well as the current urgent reason to travel to the US. In individual cases, the responsible Department of State requires, among other precautions, qualified travelers who enter the country for humanitarian, professional, medical or security reasons (national security) and/or the entry has to be in US national interests.

It is important to know in advance that the NIE can only be applied for in hold with a valid non-immigrant visa or a valid EStA non-immigrant visa and that, if the decision is successful, entry must be made once within 30 days. For a return journey and re-entry, a new NIE must be applied for separately. This works for all applicants. 

Therefore, your lawyer should be involved in the application from the very beginning in order to avoid rejection or circumstances that can be suspended in advance. Because it will be recorded in the system of Homeland Security which consequently could make a renewed application difficult or even impossible to receive.
