Autobahn: Richtgeschwindigkeit sollte eingehalten werden

Lässt sich die Schuldfrage beim Auffahrunfall auf der Autobahn nicht genau feststellen, wird regelmäßig eine Schuldquote von jeweils 50 % angenommen.

Fährt jedoch eines der beiden Fahrzeuge mit wesentlich höherem Tempo als 130 km/h - der Richtgeschwindigkeit auf der Autobahn -, wächst entsprechend sein Schuldanteil. Im entschiedenen Fall musste der Auffahrende 2/3 des Schadensersatzes zahlen, weil er mit 200 km/h erheblich zu schnell unterwegs war. Der auffahrende Autofahrer wurde nur zu 1/3 belastet, da er den „zu schnell fahrenden" Pkw beim Spurwechsel nicht mehr wahrnehmen konnte.
