Was ist eine Abmahnung?

Zunächst einmal ist eine Abmahnung eine „günstige“ außergerichtliche Möglichkeit der Streitbeilegung zwischen zwei Parteien. Der Rechteinhaber wirft Ihnen beispielsweise vor, einen Film, eine Serie, ein Lied oder andere urheberrechtliche geschützte Werke auf sog. Tauschbörsen hochgeladen zu haben.

Wenn Sie eine Abmahnung erhalten haben, so wurde möglicherweise von Ihrem Anschluss aus eine Urheberrechtsverletzung mittels Filesharing-Software begangen.

Das Urheberrecht verbietet die unerlaubte Verbreitung urheberrechtlich geschützter Werke. Wenn Sie etwas über eine Peer-to-peer-Verbindung herunterladen, so laden Sie regelmäßig gleichzeitig Datenfragmente hoch (Upload) und stellen diese damit anderen Filesharing-Usern zur Verfügung.

Hafte ich persönlich?

Dies vorangestellt empfiehlt es sich selbstverständlich und allenfalls nur nach Prüfung des konkreten Sachverhalts, eine Unterlassungserklärung abzugeben. Beachten Sie, dass Sie einen Vertrag unterschreiben. Bei der Erklärung kommt es also auf jedes Wort an.

Was muss ich jetzt tun?

Allerdings könnten Sie nach den Grundsätzen der Störerhaftung haften. Auch eine solche hängt allerdings vom Einzelfall ab und bedarf einer Prüfung. Inwiefern Sie sich exkulpieren können, bedarf einer Prüfung.

What is an „Abmahnung“?

A copyright infringement warning letter is a cheaper out-of-court way of resolving a conflict between two parties. The intellectual property holder accuses you of having uploaded a movie, television series, image, song, sample etc. protected by copyright.

Having received an „Abmahnung”, you have probably been using filesharing software such as bitorrent, eMule, popcorn time or any other peer to peer connection software.

According to German copyright law, the act of circulating a protected work is forbidden. When downloading through a peer-to-peer connection, you’re actually uploading fragments of the protected content at the same time, providing other file sharing software users with this content simultaneously.

Can I be personally held liable?

The question depends on your individual case.

Having said that, I strongly advise you not to sign the enclosed declaration to cease and desist. You should know that you are signing a binding contract. The wording of said declaration is crucial and needs to be checked by a professional.
