Ein EU Business Register versendet derzeit unzählige E-Mails, an die ein Trickformular angehängt ist, welches der betreffende Empfänger unterschreiben und zurücksenden soll.  Hierbei handelt es sich um eine sehr weit verbreitete Vorgehensweise, die in den letzten Jahren immer mehr Nachahmer gefunden hat. Sehr beliebt ist es auch, solche Formulare aus dem Ausland heraus zu versenden, da dies die Rechtsverfolgung erheblich erschwert.

Die Vorgehensweise von EU Business Register

EU Business Register übersendet an unzählige Unternehmen E-Mails mit dem folgenden Wortlaut:

Hello,

 In order to have your company inserted in the EU Business Register for 2021/2022, please print, complete and submit the attached form in a reply to this email.

Das klingt zunächst unverfänglich. Öffnet man dann aber  das anhängende Dokument, kommt ein Trickformular zum Vorschein, welches bei Unterzeichnung viel Geld kosten soll. Dort ist zwar in der „Anrede“ wie folgt ausgeführt:

Dear Company,

We are compiling information for the EU BUSINESS REGISTER. We wish tob e able to inform other EU companies about your activities. In order to list your company on the Internet for EU Businesses, just fill in and return the form. Any additional material of your company that can make your profile up to date is very welcome. We thank you for your cooperation. To update your company profile, please print, complete and return an insertion. (Updating is free of charge). 

Auffällig ist, dass hier zweimal eine vermeintliche Kostenlosigkeit mitgeteilt wird (Update is free of charge). Liest man jedoch das Ende des Trickformulars, stellt sich dies ganz anders dar. Dort heißt es nämlich:

„THE SIGNING OF THIS DOCUMENT REPRESENTS THE ACCEPTANCE OF THE FOLLOWING CONDITIONS AND THE CONDITIONS STATED IN “THE TERMS AND CONDITIONS FOR INSERTION” ON THE WEB PAGE: WWW.EUBUSINESSREGISTER.NET. THE SIGNING IS LEGALLY BINDING AND GIVES YOU THE RIGHT OF AN INSERTION IN THE ONLINE DATABASE OF THE EU BUSINESS REGISTER, WHICH CAN BE ACCESSED VIA THE INTERNET, ALL IN ACCORDANCE WITH THE CONTRACT CONDITIONS STATED ON “THE TERMS AND CONDITIONS FOR INSERTION” ON WEB PAGE: WWW.EUBUSINESSREGISTER.NET. THE VALIDATION TIME OF THE CONTRACT IS THREE YEARS AND STARTS ON THE EIGHTH DAY AFTER SIGNING THE CONTRACT. Durch eine Unterschrift soll also ein Vertrag über drei Jahre für einen Gesamtpreis von 2.985 € abgeschlossen werden.

Rechnung von EU Business Register

Unmittelbar nach Rücksendung des Formulars erfolgt die Rechnungsstellung. Den meisten Betroffenen ist gar nicht bewusst, dass sie einen kostenpflichtigen Vertrag abgeschlossen haben sollen. At first, this sounds harmless. But if you then open the attached document, a trick form appears, which is supposed to cost a lot of money if signed. There is indeed in the "salutation" as follows:

It is noticeable that a supposed free of charge is communicated here twice (Update is free of charge). However, if you read the end of the trick form, this is quite different. There it says namely:

Invoice from EU Business Register
