Kautionssystem in den Vereinigten Staaten - Teil II

Grundsätzlich ist es jedoch so, dass der Großteil der Angeklagten die durch das Gericht festgesetzte z.T. erhebliche Kautionssumme nicht selbst aufbringen kann. In diesem Bereich wird der Kautionsagent tätig, der sodann für eine Provisionsgebühr von ca. 10–30% der Kautionssumme die Kaution vor Gericht stellt und damit für den Angeklagten bürgt.

Die Kautionsbüros haben durch das Gesetz besondere Rechte erhalten, um dieses Risiko des Ausfalls zu verringern. Der Kautionsagent hat daher das Recht, den Aufenthaltsort seines Kunden, d.h. des Angeklagten zu bestimmen. Er darf ihn festnehmen – erforderlichenfalls auch unter Einsatz von Gewalt. Daher benötigt der Kautionsagent zum Ausüben seiner Tätigkeit eine staatliche Lizenz (übt also ein behördliches Amt aus) und unterliegt berufsrechtlichen Bestimmungen. 

Je nach Risikoeinschätzung wird der Kautionsagent verlangen, dass der Angeklagte beispielsweise täglich im Büro des Agenten erscheint oder zusätzlich noch anruft, um den Agenten davon zu überzeugen, dass er nicht geflüchtet ist. Dies kann auch 3 Mal wöchentlich gefordert werden und hängt allein von dem jeweiligen Agenten ab, welche Pflichten und Auflagen dieser dem Angeklagten auferlegt. 

Falls der vorgeladene Angeklagte trotz hinterlegter Kaution nicht zur Hauptverhandlung erscheint, was noch eine zusätzliche Straftat in den USA darstellt, wird dies auch das sog. skipping bail oder jumping bail genannt. Das Gericht stellt dann einen Haftbefehl aus und legt den Termin fest, zu dem die Kaution an den Staat fällt. Bis zu diesem Verfallstag muss der Kautionsagent die zugesicherte Kaution an das Gericht zahlen. Da er für den Angeklagten bürgt, muss er nun alles unternehmen, diesen zu lokalisieren, andernfalls haftet dieser insgesamt aus eigenen Mitteln. Er kann dann auch die zusätzlichen Sicherheiten, wenn er diese vom Angeklagten verlangt hat, veräußern. (Immobilien, Wertpapiere, Schuldscheine etc.). Da die vom Kautionsagenten hinterlegte Kaution beim Nichterscheinen des Angeklagten nach einer festgelegten Frist verfällt, hat er also ein starkes Interesse daran, den Flüchtigen bald zu finden. Entweder versucht er selbst ihn zu finden oder engagiert einen so genannten Kopfgeldjäger (engl.: bounty hunter). Dies ist in den USA weit verbreitet und unterscheidet sich in der Art der Ausführung je nach Bundesstaat. 

Ein Kopfgeldjäger ist also ein Privatunternehmer, der seine Aufträge und sein Honorar vom Kautionsagenten bzw. von dem Agenturbüro erhält. Damit ein Kopfgeldjäger effektiver arbeiten kann als eine sonstige Privatperson, hat er bestimmte Sonderrechte. So darf er sich beispielsweise als eine andere Person mittels Legende ausgeben, um durch Täuschung an Informationen über den Aufenthaltsort des Flüchtigen zu gelangen. Er arbeitet regelmäßig mit vertraulich und geschützten Informanten zusammen. Für Eigentumsschäden während der Festnahme haftet der Kopfgeldjäger jedoch persönlich. Die Gesetze der verschiedenen US-Bundesstaaten unterscheiden sich hinsichtlich seiner Rechte und Pflichten.

Basically, however, the majority of the accused are unable to raise the amount of bail set by the court, in some cases considerable, by themselves. In this section the bail agent / bondsman becomes active who then puts the bail in court for a commission fee of approximately 10–30% of the bail amount of charge and thus guarantees for the defendant. Bondsmen have been given special rights by law to reduce this risk of failure. The bondsman therefore has the right to determine the whereabouts of his customer, i.e. the defendant. He is allowed to arrest him - if necessary, also by the use of physical force. Therefore, the bail agent needs a state license to exercise his activity (i.e. he exercises an official office for the legal system) and is subject to professional regulations. 

Depending on the risk assessment, the bondsman will require the accused to appear in the bond agent's office every day, for example, or to call in addition to convince the agent that he has not already fled. This can also be requested 3 times a week and depends solely on the respective agent which duties and conditions he imposes on the defendant. 

If the accused does not appear before court at the court hearing despite having deposited bail which is an additional criminal offense in the US this is also called the "skipping bail" or "jumping bail". The court then issues an arrest warrant and sets the date on which the bail is due to the state. By this expiry date, the bond agent must pay the guaranteed bond to the court. Since he vouches for the accused, he must now do everything possible to locate him, otherwise he is entirely liable by his own resources. He can then also sell the additional securities if he has requested them from the defendant. (Real estate, securities, promissory notes, etc.). Since the bail deposited by the bond agent expires after a fixed period if the defendant does not appear, he has a strong interest in finding the fugitive soon. Either he tries to find himself or hires a so-called bounty hunter. This is widespread in the United States and the way it is done varies by state. 

A bounty hunter is a private entrepreneur who receives his orders and fees from the bond agent or from the agency office. So that a bounty hunter can work more effectively than any other private person he has certain special rights. For example, he can pretend to be a different person by means of a legend in order to obtain information about the whereabouts of the fugitive through deception. He works regularly with confidential and protected informants. However, the bounty hunter is personally liable for property damage during arrest. The laws of the different US states differ in terms of their rights and obligations.
